Terms & Conditions - Terrane

These Terms & Conditions ("Terms") govern your use of the Terrane mobile application (the "App") provided by Aux Ltd ("Aux", "we", "us"). By downloading or using the App, you agree to these Terms.

1. App licence (Apple Standard EULA)

Your licence to use the App is governed by Apple's Licensed Application End User License Agreement (Standard EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

These Terms supplement, and do not replace, the Apple Standard EULA. In the event of a conflict regarding the app licence itself, the Apple Standard EULA controls.

2. No accounts

Terrane does not require an account. You are responsible for your device and for the content you create with the App.

3. Audio and recordings

Terrane processes audio on your device and does not receive your listening audio or recordings. You own recordings you create with the App.

Listening audio is used only while a session is active, and is kept in volatile memory for app functionality. Audio is saved only when you choose to record.

4. Acceptable use

You agree not to misuse, reverse engineer, or attempt to disrupt the App except to the extent permitted by law. You also agree not to use the App in a way that is unlawful or infringes others' rights.

5. Health and safety

Terrane is a listening instrument, not a hearing aid, hearing protection device, or medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition.

Use the App responsibly, in a safe listening environment, and at reasonable volume levels.

6. iCloud Drive (optional)

If you enable iCloud Drive in the App, recordings and related metadata are synced to your own iCloud account. iCloud services are provided by Apple and subject to Apple's terms and availability.

7. Intellectual property

The App, including its software, design, branding, and original audio behaviors, is owned by Aux Ltd and protected by applicable laws.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or meet your specific requirements.

9. Limitation of liability

To the fullest extent permitted by law, Aux Ltd will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising out of or relating to your use of the App.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Changes to the app and terms

We may update the App and these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles, and subject to any mandatory consumer protections in your country of residence.
