Terms & Conditions — Drones (Ambient Noise Mixer)

These Terms & Conditions (“Terms”) govern your use of the Drones – Ambient Noise Mixer mobile application (the “App”), published under the name Aux Ltd (“Aux Ltd,” “we,” “us,” “our”).

Important note about the name “Aux Ltd”: “Aux Ltd” is the name used on aux.ltd to publish these policies and operate the App experience. It may not reflect a formal legal entity name in every jurisdiction. For questions or legal/compliance requests, contact info@aux.ltd.

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) The App and No Health Claims

The App provides ambient audio experiences and tools for mixing and listening to sound.

No medical or health claims: The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. We make no claims about health outcomes from listening to audio in the App. If you have medical concerns, consult a qualified professional.

2) Eligibility

You must be legally able to enter into these Terms under the laws where you live. If you are using the App on behalf of an organization, you represent you have authority to bind that organization.

3) License to Use the App

Subject to your compliance with these Terms, Aux Ltd grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial use on Apple-branded products that you own or control, as permitted by Apple’s App Store usage rules.

All rights not expressly granted are reserved by Aux Ltd.

4) Purchases and Payments (App Store)

The App is distributed through Apple’s App Store. Any paid download or purchase is processed by Apple, not Aux Ltd. Your purchase and any refund requests are governed by Apple’s terms and policies.

Aux Ltd does not control App Store billing or refunds.

5) Ownership and Intellectual Property

A) App

The App (including software, design, UI, and branding) is owned by Aux Ltd and/or its licensors and is protected by applicable intellectual property laws.

B) Audio Content

All audio files made available in the App are composed, captured, performed, and/or produced by Aux Ltd, unless explicitly stated otherwise.

You may listen to and use the audio within the App for personal enjoyment. You may not, without prior written permission from Aux Ltd:

  • copy, extract, or redistribute audio files outside the App,
  • sell, sublicense, or commercially exploit the audio,
  • upload the audio to streaming platforms or sample libraries,
  • create derivative works intended for commercial release.

6) Acceptable Use and Restrictions

You agree not to:

  • reverse engineer, decompile, or attempt to derive source code from the App (except where permitted by law),
  • bypass, disable, or interfere with security or access controls,
  • use the App in a way that violates applicable laws,
  • infringe intellectual property rights or attempt unauthorized access to systems related to the App.

7) Analytics and Privacy

The App uses analytics (Firebase / Google Analytics) to understand usage patterns and improve stability and performance. The App does not require accounts.

8) Updates and Changes to the App

We may modify, update, or discontinue the App (or parts of it) at any time, including to:

  • improve performance,
  • fix bugs,
  • change features or UI,
  • comply with law or platform requirements.

We do not guarantee that any specific feature will remain available.

9) Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUX LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, error-free, or meet your requirements.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUX LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.

IN NO EVENT WILL AUX LTD’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID (IF ANY) TO PURCHASE THE APP THROUGH THE APP STORE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11) Indemnification

You agree to indemnify and hold harmless Aux Ltd and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the App,
  • your violation of these Terms,
  • your violation of any law or third-party right.

12) Termination

You may stop using the App at any time by uninstalling it.

We may suspend or terminate access to the App if you violate these Terms or if we reasonably believe it is necessary to protect the App, users, or Aux Ltd.

Sections that by their nature should survive termination (including Ownership, Disclaimers, Limitation of Liability, and Indemnification) will survive.

13) Changes to These Terms

We may update these Terms from time to time. We will update the dates at the top of this page. Continued use of the App after changes means you accept the updated Terms to the extent permitted by law.
